US court forbids free sampling
As long as Samples were not
clearly recognizable, so the past law
practice in the States, the licenses for
it hadnīt to be clarified. Differently the
DJ culture (particularly inits beginnings)
would have had probably bad problems.
And even Vanilla Ice had the bass reef
of 'Under Pressure' for 'Ice Ice Baby'
first without clarifying the rights uses.
Now however.. recently in Nashville there
was a law suit with the 1991 dissolved
HipHop boys N.W.A. ...they used a 2-minute
(!!) George Clinton sample in their track
'100 Miles and Runnin' without having a license.
Ice Cube, Dre & CO didnīt give a damn, but the judge simply uttered "get a license or donīt sample" and also states that "we donīt
believe that this decision derogates artist creativity!"
If this judgement should not be revised, it
became valid right and would not remain
only valid in the USA but globally. .
no more free sampling ...even if itīs 1 or 2 seconds only. tsk.
